Winglytics Terms of Service

1. Acceptance of Terms
By using or accessing the Winglytics website ("Site") and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, do not use the Service.

2. Description of Service
Winglytics is a SaaS platform that helps startups, indie makers, and marketers get discovered inside AI tools through semantic optimization and content strategies.

3. User Accounts
a. Account Registration: To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration.

b. Account Security: You are responsible for maintaining the security of your account and password. Winglytics cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. User Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to the Service or related systems

5. Intellectual Property
a. Our Content: The Service and its original content, features, and functionality are owned by Winglytics and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

b. User Content: You retain all rights to any content you submit, post or display on or through the Service. By submitting content to Winglytics, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content.

6. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by Winglytics. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Termination
a. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

b. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WINGLYTICS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability
IN NO EVENT SHALL WINGLYTICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Changes to Terms
Winglytics reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without respect to its conflict of laws principles.
